Junk Removal Terms of Service

GetJNKD LLC · Version 0.1 · 23 September 2026 · Governed by Colorado law

1. Who this agreement is between

These terms are an agreement between GetJNKD LLC, a Colorado limited liability company trading as GetJNKD ("GetJNKD", "we", "us"), and the person or entity who approves a GetJNKD quote ("you").

Your agreement with us is made up of three documents, and where they conflict they apply in this order: (a) the Quote Acceptance page you approved, and any signed addendum; (b) these Terms of Service; (c) the quote itself, which sets out the described scope and the estimated price, subject to the on-site confirmation in section 3.

The version of these Terms in effect on the date of your job is the version that applies to it. We may change these Terms for future jobs.

2. What we do

We remove and dispose of unwanted household and commercial items from your property. Our crew provides the labor — you do not need to move anything to the curb unless you want to.

Pricing is by volume: how much space your items take up in our truck, measured against the fraction-of-truck tiers on our current rate sheet. Each job includes a disposal allowance of up to 1.5 tons. Items that cost us more to dispose of — mattresses, appliances, appliances containing refrigerant, tires, large electronics, and heavy construction material — carry the per-item surcharges shown on our rate sheet, which cover the disposal facility's charge.

The rate sheet in effect on the date of service applies. Travel outside our base service area may carry a travel charge, which will be shown on your quote before you accept it.

3. Quotes, the on-site price, and changes

3.1 Photo quotes are estimates. A price quoted from photographs or a description is an estimate. Volume is difficult to judge from a photo, and weight is impossible. The binding price is the one we confirm on site, in front of you, before work starts.

3.2 Nothing starts until you agree to the price. Our crew will look at the job, tell you the price, and start only when you say yes. If the on-site price is higher than the estimate and you would rather not proceed, you may cancel at that point at no charge.

3.3 If the job changes while we are working. If you add items, or we find materially more than we were shown, we will stop, tell you the revised price, and continue only once you approve it.

4. What we cannot take

We are not licensed to handle hazardous materials, and we will not take them. This includes hazardous waste, wet paint, chemicals, solvents, fuel, oil, propane tanks, asbestos, and medical or biohazardous waste. If you have these, tell us and we will point you to where they can be taken — we would rather help you solve it than simply refuse.

We also do not take concrete, brick, dirt, rock, tile or masonry, which exceed our vehicles' weight limits.

If prohibited material is discovered in a load after we leave, you are responsible for the cost of its proper disposal and any fine, surcharge or rejected-load fee the disposal facility charges us, and we may invoice you for it.

Appliances containing refrigerant leave your property intact. We do not recover refrigerant on site. Units are delivered to a facility permitted to accept them, which performs recovery in accordance with federal law; the refrigerant surcharge covers that facility's fee.

5. You decide what leaves

This is the heart of how we work, and it is a promise, not a formality.

5.1 We remove only what you identify. Our crew takes only the items you point out or approve. We do not "clear a room" or "take everything in the garage" on our own judgment. If an item is not clearly part of what you showed us, we ask.

5.2 If we are unsure, we stop and ask. Where an item is ambiguous — it looks valuable, it looks personal, it is not obviously with the pile — the crew will ask you before it is loaded. If you are not reachable in that moment, the item stays.

5.3 Please be present, or send someone who can decide. We strongly prefer that you or an adult you authorize is on site for the whole job. If nobody is present, we can only remove items you have identified in advance in writing, clearly separated or marked, and we will not exercise judgment about anything else.

5.4 Things to do before we arrive. Please search drawers, pockets, boxes, safes and furniture for cash, jewelry, keys, documents, medication, hard drives, firearms and anything of sentimental value, and remove them from the work area. Most mistaken-disposal problems begin inside a piece of furniture nobody opened.

5.5 You can stop at any time. Up until our vehicle leaves your property, you can tell us to put something back, and we will.

6. Ownership and authority

By approving your quote you represent that you own the items to be removed, or that you have the legal right and authority of their owner to have them removed and disposed of.

If you are acting as a landlord disposing of property left behind by a tenant, as the personal representative of an estate, or as an agent, property manager or contractor for an owner, the Authority to Remove Addendum applies and must be signed. Different rules — including Colorado's requirements for property left behind by a tenant — apply in those situations, and meeting them is your responsibility, not ours.

You agree to indemnify and hold GetJNKD harmless against any claim brought by a third party asserting an ownership or possessory interest in items we removed at your direction, including our reasonable costs of defense.

7. Title, Disposal and Resale

This section is written the same way in every GetJNKD service agreement. It is the part of this contract we most want you to actually read.

WHEN AN ITEM IS LOADED, IT BECOMES OURS. WE MAY RESELL IT.
Ownership of and legal title to each item pass from you to GetJNKD LLC at the moment that item is placed on our vehicle, in our container, or otherwise taken into our possession for removal. From that moment the item is ours, and what happens to it is our decision. We may throw it away, recycle it, scrap it, donate it — or clean, repair, photograph, list and sell it for our own profit.

7.1 You receive nothing from a sale. You are not entitled to any share of, or any accounting for, money GetJNKD receives for an item. The price you pay for the job is the same whether we scrap the item, give it away, or sell it well.

7.2 We are not buying your property. The price you pay is for the work of removing and disposing of your items. It is not a price for the items. GetJNKD does not purchase items from customers. We do not accept goods instead of payment or as a credit against anything you owe us, and we do not reduce, discount or offset a price in exchange for anything in the load.

No employee, crew member or contractor of GetJNKD has authority to appraise, bid on, buy, or make an offer for anything you own, or to tell you what an item is worth. If someone working on our behalf offers to buy something from you, they are acting outside their authority — please tell us at contact@getjnkd.com.

7.3 One person decides what gets resold. Whether an item is resold rather than disposed of is decided solely by GetJNKD's Director of Resale Operations. Field crew play no part in that decision and are not permitted to set items aside for resale on their own judgment.

7.4 Where resold items are kept. Items kept for resale are stored at a private, non-public location. GetJNKD does not operate a yard, store or salvage lot open to the public, and does not receive visitors to view, inspect or collect items.

7.5 We hold resale items for 72 hours. GetJNKD will not sell, list for sale, or scrap any item it keeps for resale from your job until at least 72 hours after your job is completed. That window exists so that a concern raised under the Claims section can still be acted on.

This hold can only apply to items we keep. It cannot apply to items delivered to a transfer station or recycler — see the next paragraph.

7.6 Disposal is immediate and cannot be undone. Most loads travel directly from your property to a transfer station or recycling facility the same day. On arrival, material is tipped, commingled with other loads, compacted or processed. After that, no item can be identified, located or recovered — not by us, not by the facility, and not by you. We make no promise to attempt recovery of anything delivered for disposal, because no such attempt can succeed.

This is the single most important reason we ask you to confirm the load before we leave your property.

7.7 Asking for something back. Once title has passed, you have no right to the return of an item. If you contact us within the claim window and the item is still in our possession, we will normally return it at no charge as a matter of goodwill. That is a courtesy we choose to extend, not an obligation we owe.

7.8 Why we tell you this. We put this in writing because it is true, and because you should know it before you decide what goes on the truck. If you would rather sell something yourself, keep it. Once it is loaded, the decision is ours.

8. Confirming the load before we leave

At the end of every job we ask you to review what we removed and sign a short completion sign-off confirming that everything we took is everything you wanted taken, and noting any damage.

If you are not present at completion, we will send the sign-off to you electronically. If you do not return it, the 48-hour claim window in section 9 still runs from the time the job was completed.

9. Claims, limits and your remedies

9.1 Tell us within 48 hours. Any claim arising from a job — including a claim that an item was removed which you meant to keep — must be given to us in writing at contact@getjnkd.com, or by phone to (720) 868-2469, within 48 hours after the job is completed. A claim not made within that period is waived, to the fullest extent Colorado law allows.

9.2 Items removed with your approval

YOU AGREE THAT GETJNKD IS NOT LIABLE TO YOU FOR ANY ITEM REMOVED FROM YOUR PROPERTY WITH YOUR APPROVAL, INCLUDING AN ITEM YOU LATER DECIDE YOU DID NOT MEAN TO PART WITH, AND INCLUDING WHERE THAT ITEM HAS BEEN DISPOSED OF OR RESOLD.
You give up any claim for the value of such an item, whether the claim is framed as negligence, conversion, breach of contract, or anything else. This waiver does not cover conduct that is willful and wanton, and it does not cover bodily injury.

This waiver is the reason we take the confirmation in section 8 seriously, and the reason our crew asks rather than assumes.

9.3 If a court does not enforce section 9.2. If a court holds that the waiver in section 9.2 is unenforceable in whole or in part, then GetJNKD's total liability to you for all claims arising out of the job is limited to the amount you paid GetJNKD for that job. The rest of these Terms remain in force.

9.4 What we are never liable for. GetJNKD is not liable for sentimental value, for indirect, incidental, special, punitive or consequential damages, for lost profits or business interruption, or for data on any device or drive included in a load.

9.5 Property damage is treated separately. Section 9.2 applies to items removed. It does not apply to physical damage to your home or property, which is handled under section 10 and is not waived.

9.6 Limits of these limits. Nothing in these Terms limits any liability that cannot be limited under Colorado law, including liability for bodily injury caused by our negligence, for willful and wanton conduct, or under the Colorado Consumer Protection Act.

10. Access, your property, and damage

10.1 Access. You agree to give us safe and lawful access to the items, and to tell us about anything we could not reasonably see for ourselves — a soft spot in a floor, a septic field under the driveway, a low limb, a step that gives.

10.2 Protecting surfaces. Tell us about floors, thresholds, paintwork or landscaping you are concerned about and we will lay protection and route around them. Ask us and we will park on the street instead of the driveway.

10.3 Tight spaces. If an item cannot be removed without contacting a doorway, wall or railing, we will tell you before we try. If you ask us to proceed anyway, we are not responsible for marks or damage that result from that route.

10.4 If we damage something. Note it on the completion sign-off, or tell us within 48 hours, and we will repair it or put it through our general liability insurance. We would far rather fix a wall than argue about it. We are not responsible for damage that was already there, which is one reason our crew photographs the work area before and after.

10.5 Vehicles on driveways. Loaded trucks are heavy. Ordinary surface wear, and cracking of a driveway already at the end of its life, is a risk of having a truck on it. Where you prefer, we will stay on the street and carry.

11. Payment

Payment is due on completion of the work. We accept card payments through Jobber, and Venmo, Zelle and cash. A receipt is emailed to you.

Amounts unpaid more than ten days after completion may accrue interest at the highest rate permitted by Colorado law, and you agree to pay the reasonable costs of collection, including attorney fees, we actually incur.

GetJNKD never asks for payment in goods. See section 7.2.

12. Taxes

Prices quoted are exclusive of any tax that may be required by law. Where tax applies to any part of a job, it is shown as a separate line on your quote and invoice.

Any later sale by GetJNKD of an item after title has passed is a separate transaction between GetJNKD and its buyer. You have no obligation, liability or tax exposure in connection with it.

13. Cancelling, rescheduling and access failures

You may cancel or reschedule a junk removal job at no charge by telling us before our crew is dispatched to you.

If our crew arrives and cannot work — nobody is home and access was required, the property is inaccessible, or the job is materially different from what was described and you decline the revised price — we may charge our published minimum service charge for the trip.

14. Safety, and when we will stop

Our crew may decline or stop work where conditions are unsafe: unrestrained or aggressive animals, structural risk, biohazard, infestation, threats or intoxication, or weather that makes footing or driving unsafe. Where we stop for safety, you pay only for work completed.

We do not enter crawlspaces or attics that cannot be entered safely, and we do not disconnect gas, electrical or plumbing connections. Appliances must be disconnected before we arrive.

15. Photographs, video and recordings

Our crew photographs and films the work area before and after each job. Those images are how we prove what condition your property was in and what was removed, and they are part of our records.

You grant GetJNKD permission to use photographs, video and audio recordings taken by our crew on your property for marketing and training, provided we first remove or obscure anything that could identify you or your home — faces, tattoos and distinctive marks, house numbers, street signs, vehicle plates, mail, documents and screens — and provided your voice is not recognizable. We will never publish the address of a job.

If we want to publish something in which you are recognizable — your face, or your voice — we will ask you to sign a separate Photo & Video Appearance Release first. Signing it is entirely optional, and whether you sign it has no effect on your price, your service or your scheduling.

Photographs you send us to get a quote are different. Those are used only to price and schedule your job, and are never used for marketing.

If you would rather we did not use any image, footage or recording from your job, tell us before we publish it and we will not. Once something is published we cannot reliably recall it, so we do not promise removal after the fact.

16. Privacy and communications

What we collect and how we handle it is set out in our Privacy Policy at getjnkd.com/privacy. Messages about your job — quotes, scheduling, on-the-way notices, invoices — are part of the service you asked for. Marketing emails and marketing texts are separate, are never a condition of service, and go only to people who ticked the relevant box. Our SMS Terms are at getjnkd.com/sms-terms.

17. Insurance

GetJNKD carries commercial general liability insurance and Colorado workers' compensation coverage for its employees. Evidence of coverage is available on request.

We do not insure your items. Once title passes under section 7, they are our property; before that, they are yours.

18. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules.

If something goes wrong, contact us first — most problems are cheaper and faster to fix directly. If we cannot resolve it, either of us may bring the dispute in the Small Claims Division of the County Court for Arapahoe County, Colorado, where the amount qualifies. Any dispute that does not qualify for small claims shall be brought in the state courts located in Arapahoe County, Colorado, and both of us consent to that venue and jurisdiction.

19. General

19.1 Entire agreement. The Quote Acceptance page, any signed addendum, these Terms and your quote are the entire agreement between us about this job, and replace any earlier discussion or understanding.

19.2 Severability. If any provision of these Terms is held unenforceable, it is modified to the least extent necessary to make it enforceable, or severed if it cannot be; the remainder stays in force. Section 9.3 states expressly what happens if section 9.2 is not enforced.

19.3 No waiver. If we do not enforce a provision on one occasion, that is not a waiver of it on any other.

19.4 Electronic signature. You agree that an electronic signature, including one captured on a crew member's device or through Jobber, has the same effect as a signature on paper, under the Colorado Uniform Electronic Transactions Act.

19.5 Assignment. You may not assign this agreement. We may assign it to a successor to our business.

19.6 Notices. Notice to us: contact@getjnkd.com, or GetJNKD LLC, 1500 N Grant St #6176, Denver, CO 80203. Notice to you: the email address, phone number or service address on your job record.

19.7 Events outside our control. Neither of us is responsible for failing to perform because of something genuinely outside our control — severe weather, road closure, fire, flood, or a disposal facility's closure. We will reschedule at no charge.
